1. Acceptance of Terms
By accessing or using Vitaria ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App. The App is operated by Creative Skyline Ltda. ("we", "us", "our").
2. Service Description
Vitaria is a personal health companion app for tracking supplements, managing intake records, organizing appointments, maintaining a doctor directory, and storing medical documents. The App is designed to help you manage your personal health information in one place.
Important: Vitaria is not a medical device and does not provide medical advice, diagnoses, or treatment recommendations. The App is a personal organizational tool and should not be used as a substitute for professional medical consultation.
3. Account Registration
To use Vitaria, you must create an account by providing a valid email address and password. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Providing accurate and current information
- Notifying us immediately of any unauthorized use of your account
4. Permitted Use
The App is intended for personal, non-commercial health tracking only. You agree not to:
- Use the App for any commercial purpose
- Attempt to reverse engineer, decompile, or disassemble the App
- Use the App to store or transmit malicious content
- Interfere with or disrupt the App's infrastructure
- Share your account with others or create accounts on behalf of others without their consent
5. Content Ownership
You retain full ownership of all data you enter into the App, including supplement information, intake records, appointments, doctor details, and uploaded documents. We do not claim any ownership rights over your content.
You grant us a limited license to store, process, and display your content solely for the purpose of providing the App's services to you.
6. Limitation of Liability
The App is not a substitute for professional medical advice. We are not liable for any health decisions you make based on data stored in or displayed by the App. Specifically:
- We do not verify the accuracy of supplement dosages, appointment details, or any other health information you enter
- We are not responsible for missed appointments, incorrect dosages, or any health-related outcomes
- The App is provided "as is" without warranties of any kind, express or implied
- Our total liability to you for any claims arising from use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim
7. Service Availability
We strive to keep Vitaria available at all times, but we do not guarantee uninterrupted or error-free operation. We may temporarily suspend the service for maintenance, updates, or reasons beyond our control. We are not liable for any loss or inconvenience caused by service interruptions.
8. Account Termination
You may delete your account at any time through the App. Upon deletion, all your personal data will be permanently removed from our servers.
We reserve the right to suspend or terminate your account if you violate these Terms of Use or use the App in a manner that could harm the service or other users. We will provide notice before termination where reasonably possible.
9. Changes to These Terms
We may update these Terms of Use from time to time. Material changes will be communicated through the App or by email. Your continued use of the App after changes take effect constitutes acceptance of the revised terms.
10. Governing Law
These Terms of Use are governed by the laws of the Federative Republic of Brazil. Any disputes arising from or related to these terms or your use of the App shall be submitted to the exclusive jurisdiction of the courts of Fortaleza, State of Ceara, Brazil.
